Terms of Service

Applies to new bookings made on or after 7 September 2026. Earlier bookings keep the terms agreed when booked. Nothing in this update reduces mandatory consumer rights or more favourable rights already agreed with you.

These Terms of Service govern your use of chinatourly.com and any journey bookings made through ChinaTourly. By accessing our website or confirming a booking, you agree to these terms. Please read them carefully before proceeding.

1. About ChinaTourly

ChinaTourly arranges private journeys throughout mainland China through independent suppliers and ground partners. The service scope and contracting party for each booking are stated in the written journey proposal and booking confirmation.

2. Booking & Contract

A booking is confirmed when we issue written booking confirmation and receive the payment required by your selected plan, whether full payment or deposit, subject to any earlier contract formation required by law. Your written quote identifies the contracting party, services, payment schedule and terms before payment. The contract incorporates these Terms, your agreed proposal and the Refund & Cancellation Policy applicable when you book. Later website updates do not automatically change that contract.

All participants in a booking are bound by these Terms. The lead booker accepts these Terms on behalf of all members of their group.

3. Your Responsibilities

You are responsible for:

  • Ensuring all travellers hold valid passports (minimum 6 months' validity beyond travel dates)
  • Obtaining the correct visa for China — we provide guidance but cannot guarantee visa issuance
  • Purchasing adequate travel insurance before departure (strongly recommended)
  • Providing accurate personal and health information where requested
  • Complying with the laws and customs of the People's Republic of China throughout your journey

4. Our Responsibilities

We will: design your journey to a professional standard; select reputable suppliers and ground partners; provide qualified English-speaking guides where specified; and respond to any in-journey issues within a reasonable timeframe.

Airline changes, government restrictions, weather and other events may affect a journey. We will explain the effect and available options. These events do not remove our obligations or your mandatory refund and other consumer rights; the Refund & Cancellation Policy distinguishes voluntary cancellation from operator cancellation and statutory fee-free rights.

5. Itinerary Changes

Minor operational changes may be needed for safety or logistics while maintaining the agreed character and quality of the journey. We will notify you of significant changes and explain the options, including any applicable right to cancel without a fee and receive a refund. An alternative trip or credit is optional; mandatory rights are unaffected.

6. Pricing

All prices are quoted in USD unless stated otherwise. Prices are confirmed at booking and are not subject to fuel surcharges or currency fluctuation adjustments once the required full payment or deposit has been paid.

The full-payment plan gives 20% off the journey price, paid in full. The deposit plan gives 10% off: you pay 20% of that discounted journey total at booking, with the remaining 80% due on the date stated in your written quote. The selected payment plan, discounted total, amount due now and balance date are shown before payment.

Both payment plans include one intangible cultural heritage (ICH) experience for each purchased traveller. Full payment also includes, per booking, one room upgrade for one night, one vehicle upgrade for one day and local gifts. The experience, participants, room and night, vehicle and day, and local gift details are agreed in writing before payment. There is no additional spend threshold.

7. Liability Limitation

To the extent applicable law permits, liability for indirect or consequential loss is excluded and liability under a booking is limited to the journey price paid. These limits do not apply where liability cannot lawfully be excluded or limited, and do not restrict mandatory refund, compensation or other consumer remedies.

8. Disputes

Subject to non-waivable consumer protections, these Terms are governed by the laws of the People's Republic of China. Referral to the Tianjin Arbitration Commission applies only where the arbitration agreement is valid and enforceable for your booking; it does not remove any mandatory right to bring a claim in a competent court or rely on applicable consumer law.
